On October 23, 2014, the Fourth Plenary Session of the 18th Central Committee of the Communist Party of China (CPC) adopted and issued the Resolution on Major Issues Concerning Advancing the All-round Lawbased Governance. In Part II entitled “Improving the Socialist Legal System with Chinese Characteristics with the Constitution as the Core and Strengthening the Implementation of the Constitution” of the Resolution, Point 3 calls for thoroughly promoting scientific and democratic legislation: strengthening the role of the National People’s Congress (NPC) in the organization and coordination of legislative work, improving the legislative mechanisms for drafting, verification, coordination and deliberation, enhancing the mechanism of soliciting legislative opinions from the people’s congresses at the next lower level, establishing a system of primary-level legislative contact points, and promoting the refinement of legislation, etc.
In response to this, the Legislative Affairs Commission of the NPC Standing Committee launched a pilot scheme in early 2015 for building primary-level legislative contact points based on the basic situation of those communities already established by people’s congresses in various localities across China. With the approval of the NPC Standing Committee, the Legislative Affairs Commission quickly conducted preliminary research and survey work and inspected the units for establishing primary-level legislative contact points recommended by local people’s congresses.
After reporting the pilot scheme to the leaders of the NPC Standing Committee for official written instructions and approval, the Legislative Affairs Commission unveiled the first group of four pilot primary-level legislative contact points in China in July 2015. One of the communities was Hongqiao Sub-district in Shanghai’s Changning District.
Why did the Legislative Affairs Commission of the NPC Standing Committee select Hongqiao Sub-district? Judging from the provinces (municipality) where the four pilot primary-level legislative contact points are located, it can be seen that each community respectively represents the economic and social conditions in the west, central and east parts of the country. Representing the regions that have yet to come out of poverty in West China is Lintao County in Dingxi City, Gansu Province, while Xiangfan City of Hubei Province and Jingdezhen City of Jiangxi Province are the representatives of underdeveloped regions in Central China. Representing the developed coastal regions in East China is Hongqiao Sub-district in Changning District, Shanghai. The primary reason why Hongqiao Sub-district was chosen is that it serves as a representative of sub-district offices, which are basic urban community-level units, in China’s developed regions. Yet out of 104 urban sub-districts (excluding villages and towns) in Shanghai, why was Hongqiao Sub-district chosen? The answer actually is derived from the second reason behind the selection of Hongqiao Sub-district.
In summary, Hongqiao was chosen because it is typically characterized as being “a modern area with diverse residents, a developed economy, and rich resources.” To be specific, Hongqiao Sub-district is the birthplace of the Hongqiao brand, a representative example of international communities, and a typical model of community-level governance. This particular sub-district is home to four social groups: native residents, immigrated residents, foreign residents, and white-collar workers who go to work during day time but only return to sleep at night. This provides Hongqiao Sub-district with great social diversity. In fact, the sub-district is a new urban area that was born out of a blueprint drawn from what essentially was “a piece of blank paper” in a rural area. The Hongqiao Economic and Technological Development Zone, and the Gubei Foreign-related Integrated Residential Community, became two “new business cards” of Shanghai’s reform and opening-up at the end of the 20th century. Both the development zone and the new area enjoy a high degree of modernization. Hongqiao Sub-district boasts a solid foundation for governance, and the Hongchu Residential Community under its jurisdiction acts as a banner of Party building in China. Zhu Guoping, popularly known as the “Premier of the Alley” and a deputy to three successive NPCs, comes from Hongchu. The Hongqiao Economic and Technological Development Zone, a national-level economic and technological development zone in Hongqiao Sub-district, has attracted many foreign, state-owned, joint venture and private enterprises (including Fortune Global 500). It is also home to nine commercial buildings with an annual tax payment of more than RMB 100 million each, which fully demonstrates the high level of local economic development. Hongqiao Sub-district is also rich in judicial resources. Next to Hongqiao Sub-district Office is Shanghai No.1 Immediate People’s Court and Changning District Court. In addition, many law firms have settled in the sub-district.
If the Legislative Affairs Commission of the NPC Standing Committee and the Shanghai Municipal People’s Congress (SMPC) have a “preference” for Hongqiao, the above two reasons show why that is the case. Since the CPC Shanghai Municipal Committee and the Shanghai Municipal People’s Government decided in 1982 to put the Hongqiao Economic and Technological Development Zone in Changning District, Hongqiao has been playing a crucial role in the District’s development over the past four decades. It was found in the local development policies from the 8th to the 12th Five-Year Plan period; the 13th Five-Year Plan called for upholding the Hongqiao brand and enhancing the Hongqiao effect; and the 14th Five-Year Plan required more efforts to be made to promote the Hongqiao brand. The cradle of the brand is Hongqiao Sub-district.
In a wink, it has been eight years since Hongqiao Sub-district was chosen by the Legislative Affairs Commission of the NPC Standing Committee to establish a primary-level legislative contact point. What have the Party Working Committee of Hongqiao Sub-district and the Working Committee of Hongqiao Sub-district People’s Congress done in the past eight years? What results have they achieved? That is what will be answered in this collection of stories on the whole-process people’s democracy.
After becoming the only primary-level legislative contact point established by the Legislative Affairs Commission of the NPC Standing Committee at the sub-district level in China in July 2015, Hongqiao Sub-district has been designated as a primary-level legislative contact point by the SMPC Standing Committee and the SMPG. Looking back at the past seven years, we have explored six aspects, achieved corresponding results, and gained valuable experience.
First, specify the work principles. When Hongqiao Subdistrict Primary-Level Legislative Contact Point (the Legislative Contact Point) was first established, we came up with, after holding discussions, the brief work principles to guide the work about the Legislative Contact Point, “highlighting characteristics, ensuring extensive coverage, making rational allocation, advocating virtues, upholding the rule of law, and paying attention to practical results.”
Second, establish a working structure referred to as “One Body with Two Wings.” We set up primary-level legislative information collection points in 16 residential communities and 70 organizations in the jurisdiction, and a working structure has taken shape, with 420 advisors as the main body, in addition to 15 consulting organizations and 15 expert talent pools as the “Two Wings.”
Third, improve workflows. We detailed 8 specific responsibilities of the Legislative Contact Point, which include offering daily service guidance, soliciting comments on draft laws, participating in legislative research, and listening to community responses to and public opinion on the implementation of laws Additionally, we specified 8 workflows for soliciting comments on draft laws, including initiating consultation tasks, making preliminary interpretations and studies, formulating work plans, soliciting opinions and suggestions, forming draft reports, consulting professionals, submitting final reports, and promoting legal construction.
Fourth, form the “1-2-3-4” working methods. We have adhered to an approach that combines the people and individuals with specialized expertise. It also blends universality with accuracy. This approach involves sending draft laws and position statements to the advisors and liaisons one week in advance; we hold two types of symposiums: one for residents and one for experts. We have always solicited opinions in three forms: texts; interview, investigation and discussion; online questionnaire and discussion. We convene at least four symposiums to listen to opinions on each draft law. In doing so, we have further expanded the scope of opinion solicitation and diversified the methods of opinion solicitation to improve the quality of opinion solicitation.

Based on Soft Power, Hongqiao Sub-district Provides a Wonderful Interpretation of New Practices in People’s Democracy
